Terms of Service

1. Acceptance of Terms

By accessing and using Talkify's cloud PBX platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Service.

2. Description of Service

Talkify provides a cloud-based PBX (Private Branch Exchange) platform that includes features such as SIP trunking, call routing, IVR menus, call recording, AI voice agents, broadcasting, and analytics. The Service is available as both a SaaS (cloud-hosted) and Enterprise (on-premise) solution.

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription & Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise stated
  • We reserve the right to modify pricing with 30 days advance notice
  • Failure to pay may result in service suspension

5. Acceptable Use

You agree not to:

  • Use the Service for illegal activities including fraud, harassment, or spam calls
  • Violate any telecommunications regulations
  • Attempt to gain unauthorized access to other accounts or systems
  • Distribute malware or engage in denial-of-service attacks
  • Resell the Service without written authorization

6. Data Ownership

You retain ownership of all data you upload or generate through the Service, including call recordings, contacts, and configurations. We do not claim ownership of your content.

7. Service Level Agreement

Talkify commits to 99.9% uptime for SaaS deployments. Enterprise SLA terms are defined in individual enterprise agreements. Scheduled maintenance windows are communicated in advance.

8. Limitation of Liability

To the maximum extent permitted by law, Talkify shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Service.

9. Termination

Either party may terminate the subscription at any time. Upon termination, your data will be retained for 30 days, after which it will be permanently deleted. You may export your data before termination.
